Alternative Dispute Resolution Assessment
The Alternative Dispute Resolution Assessment is the individual assignment for the business law course this week. The alternative dispute resolution (ADR) is commonly use to resolve the disputes that arise among members of the learning teams. This type of dispute resolution is a process which a third impartial person (mediator) gets involved and assists the learning team to reach a consensus were the members agree too.
The alternative dispute resolution is a tool use by mediator to open the channels of communication among the learning team members, and this process may help the team to resolve the disputes faster. As members of a learning team, we have decided that all the disputes not resolve the same day they arise will go automatic through the alternative dispute resolution. There are few issues that may bring conflicts to the team such as the uneven division of the work, not turning the part of the work assign in a reasonable time, poor participation in the team, lack of respect to the members of the team.
All team members should participate in the process of mediation. The persons not directly involve in the dispute will have the authority to assign a mediator to conduct the process. This process will be a voluntary for all members. The mediation process will not have a formal procedure, and the mediator will hear all sides of the dispute. It is important to mention that a voluntary consensus needs to be reach, and if this consensus is not reach the dispute will advance to an arbitration process.
The arbitrator will be a different from the mediator, and the decision taken by the appointee will be final. As a team we want to avoid all this type of process to increase productivity and good performance of all team members.
