Synopsis of Tort Cases Paper
Scenario 1
In this scenario there are many unintentional torts are committed.   First assault and battery are committed by both Daniel and Malik.   Daniel committed assault and battery when he shoves Malik, and Malik commits assault and battery (with a deadly weapon) when he points the gun at Daniel.   The lady at the concession stand committed defamation of character by slandering Daniel in public and in front of Daniel’s boss resulting in Daniel losing his job.   In response to Malik pointing at gun at Daniel, Daniel pulls out his concealed weapon and shoots Malik, but in the instance Daniel felt as though his life was being threatened and had the right to protect himself and bare arms under the United States Constitution.   In the other hand, Daniel committed another intentional tort inflicting emotional distress upon Malik’s wife, after seeing her husband shot.   In this scenario I noticed two unintentional torts committed: the football stadium officials, against Malik when the railing gave way when Malik tried to stop himself from falling, which is negligent; and also the concession stand lady who was negligent for giving Daniel two sugary drinks when he ordered two diet drinks, causing Daniel to fall into a diabetic coma.  
There are several potential plaintiffs in this scenario.   The first being Daniel verses Malik for assault and battery with a deadly weapon for pointing the gun at Daniel, which cause an immediate threat of harm.   Daniel is also a possible plaintiff against the concession stand lady who committed the unintentional tort of negligence when she gave Daniel two sugary drinks instead of two diets, resulting in Daniel falling into a diabetic coma.     Malik could be a possible plaintiff verses Daniel who committed assault and battery when he shoved Malik.   In addition, Malik could have a case against the stadium officials due to the stadium railing failing when Malik tried to catch...
