CRT/205 Supporting a Position Week 1
I do agree with capital punishment laws and what they stand for. Without capital punishment criminals could do anything they wanted, knowing their only consequence would be jail time. To even be considered for the death penalty, one has to do something so morbidly heinous against one’s fellow man that a jury decides if one should live or die. This usually consists of the crimes of terrorism, rape, or murder. It is my opinion, if one takes an innocent life, one’s life should be taken as well.

No one actually witnessed the shooting death of manager Joseph Nagy. Most of the patrons and employees had been confined to a restroom and a dancer hiding under the bar did not see who fired the shots which killed Nagy. The case remained unsolved for four years until 1983, when Nieves' girlfriend told police he was involved in the crimes. Angel "Sammy" Toro and Angel Nieves were charged with murder. A third man, "Willie," was never identified, according to a summary of his case by the Florida Commission on Capital Crimes. At his trial, Nieves conducted his own defense, with the assistance of counsel. Toro cut a deal with prosecutors and was sentenced to life in prison. The conviction was largely based on the testimony of a jailhouse informant, Ralph Gajus, who occupied a nearby cell and said Nieves — who spoke poor English — admitted he was the triggerman by miming the shooting. The jury recommended he be sentenced to death by an 8-4 vote.†(Angel Nieves Diaz #1057, 2006)
