EEOC Presentation
Throughout the history of the United States there have been cases of discrimination, and harassment in the workplace with few laws to protect employees from these practices.   Title I of the Americans with Disabilities Act (ADA) as amended by the Americans with Disabilities Amendments Act of 2008 (ADAAA) prohibits companies from denial of reasonable accommodation and retaliation against individuals (EEOC, 2012).     In Greenville TN., Wal-Mart Stores Inc. will pay $275,000 to a former employee to settle a disability lawsuit filed by the United States Equal Employment Opportunity Commission (EEOC) (EEOC, 2012).   Faye Williams, regional attorney for the EEOC, said “There is a solid body of federal law that clearly obligates employers to provide an employee with a reasonable accommodation unless it poses an undue hardship” (EEOC, 2012).
The EEOC is responsible for enforcing federal laws that make it illegal to discriminate against a job applicant or an employee.   If any employee believes he or she has been or currently is a victim of employment discrimination he or she may file a charge of claim with the EEOC (EEOC, 2012).   The EEOC has the authority to investigate charges of discrimination against employees covered by the law.   The role of the EEOC in an investigation is to fairly and accurately assess the allegations in the charge and make a finding (EEOC, 2012).   If the EEOC finds discrimination has occurred, they will try to settle the charge.   If the settlement process is unsuccessful the EEOC has the authority to file a lawsuit to protect the rights of individuals and the interest of the public (EEOC, 2012).
