Legal analysis is a very detailed process of analyzing the legal questions raised by the facts of a client’s case and communicating that analysis in written form. The object of legal analysis is to analyze the factual event presented by the client and determine: what legal issue(s) are raised by the factual event, what law governs the legal issue, and how that law that governs the legal issue applies to the factual event and if any legal remedy is available. Once the analysis is complete the client can then be advised of the right they have as well as duties and options for legal remedy. Before you begin analyzing a case the first thing you must do is to gather the facts and do some background research on the area of law involved.
The facts of this case would be as follows: On May 23rd a call came in from Marilyn Lark stating that her daughter-in-law and son were behaving in a way to make Marilyn think a fight was going to break out. When the officer arrived Marilyn had said that her son Doug had been damaging the restaurant and left the premises in her husband Jake’s car, a yellow 1975 Plymouth Duster. Jake had said that as Doug was leaving the restaurant he was “spinning donuts†in the parking lot. Marilyn indicated that Doug was throwing glassware and pots, and Jake was in Doug’s face in a “menacing manner with a large sauce pan in his hand.†The officer observed that only two small glasses and a cup had been broken and the monetary value of the damage was unavailable. Later that day after the officer had cleared the premises he went to the Doug Lark residence where he verified that Jake’s car was in the driveway. When the officer ran the plates it came back as owned by Marilyn and Jake Lark. Denise indicated that that the bank she worked at was the actual owner of the car and she had repossessed the vehicle that morning from the Jake and Marilyn Lark residence.
