APPELLANT’S SKELETAL ARGUMENTS

CHARGE

1. On the 29th day of October, 2004, after a four day trial (which took place over 17 Sep 2004, 27 Sep 2004, 29 Sep 2004 and 21 Oct 2004), the learned District Judge in Court no. 11 found the Appellant guilty and convicted her of the following amended charge (P1B):-

1) The abovenamed Appellant, Tan Teck San was charged under s. 186 of the Penal Code, which reads as follows:
“Whoever voluntarily obstructs any public servant in the discharge of his public functions, shall be punished with imprisonment for a term which may extend to 3 months, or with fine which may extend to $2,500, or with both.”
      Without seeking legal representation and/or any advice, he pleaded guilty as he had thought that because he had no similar antecedent and the custody threshold in his case was not serious enough to be crossed, only a fine would be imposed on him. However, he was shocked when he was sentenced in Subordinate Court No. 23 on 13 January 2010 by the Learned District Judge to two weeks’ imprisonment instead of a fine imposed on him.
